Penalties for Environmental Damage

The Legal Affairs Committee will vote on a report on the protection of the environment through criminal law by EPP-ED Vice-Chairman Hartmut Nassauer MEP on Tuesday 8th April.

The European Court of Justice has recently ruled that the EU has no competence to determine criminal penalties. Whereas the type of action to which sanctions must apply can indeed be defined at EU level, the type and level of criminal penalties must continue to be determined by Member States' national governments. The rapporteur wants to bring the current EU directive in line with the ECJ ruling.
