Mutual recognition of products in the EU

Parliament debates today the proposal on the Application of certain national technical rules to products lawfully marketed in another Member State in a report by Alexander Stubb MEP (EPP-ED, Finland). The proposal is about strengthening the functioning of the Internal Market through free and undistorted competition, by improving the free movement of products whilst ensuring a high level of consumer protection and product safety.

The issue relates to one of the cornerstones of the European Union, integration and economic growth - the free and common market in Europe. Products lawfully marketed in one Member State, and not subject to Community harmonisation, should be accepted in all Member States. The proposal for a Regulation defines the procedure which national authorities have to follow when they intend to impose a national technical rule, i.e. when mutual recognition is not being applied. The application of technical rules is the most common and costly trade barrier, accounting for almost 50% of the total barriers encountered, the total cost of which is estimated at €150 billion.

The Rapporteur fully endorses the Commission's aim to make the principle of mutual recognition reach its full potential and to give legal clarity to economic operators as well as to Member States on how the principle should be implemented.

Alexander Stubb MEP and Günter Verheugen, Vice-President of the European Commission and others will give a press conference on 'The Goods Package - overhaul of the legislation governing free movement of goods within the EU' on Tuesday 19 February after the vote.
