The European private company statute resolution: easier cross-border activities for SMEs
The Legislative affairs committee of the European Parliament agreed today on the own-initiative proposal for regulation on the European private company statute by German MEP Klaus Heiner Lehne. The EU regulation on European private companies from 2004 is in line with the concept of European Company (SE - Societas Europaea), which was first proposed 30 years ago. It gives companies operating in more than one Member State the option of being established as a single company under Community law. This enables them to operate throughout the EU with one set of rules and a unified management and reporting system, instead of having to adapt to the different national laws of each Member State where they have subsidiaries.
The proposal of Klaus-Heiner Lehne MEP is to avoid disadvantages of the SE Statute by dispensing as far as possible with references to national law and create a uniform European form of company. The SE concept covers large limited companies, while the EPC should focus on SMEs. The approval of the resolution proposal by the committee of the European Parliament is a positive step on the way to creating flexible and prosperous cross-border operating companies.
